HEALTH LAW COMPLIANCE - PART ONE

Health law in Canada is governed by the Canada Health and Food & Drugs Acts.  The statements enclosed within this website have not been evaluated by either Health Canada or the FDA of the United States.

The disclaimer "This product is not intended to diagnose, treat, cure, or prevent any disease" is required by law when a manufacturer makes a claim in dietary supplement labeling.

Boomslang Analytics Inc. does not state that its product diagnoses or prevents Covid-19 or any other disease.  A Covid-19 diagnosis can only be achieved through a positive Covid-19 test.  Prevention of Covid-19 may be accomplished by following public social health measures (ie. masking, limited social gatherings, etc..).

Boomslang Analytics Inc. does not directly or indirectly treat persons suffering from Covid-19 or other diseases. Boomslang Analytics produces science-driven, evidence-based analysis and disease process flow mapping summaries which may include potential remediation. People are informed to contact their health care professional to determine if information provided would pose any significant health risks.  People may exercise their own judgment in determining whether or not to follow the information presented.

As stated on CIPO #1192990, Boomslang Analytics Inc. does make the claim of identifying TEN Covid-19 cures.  This claim is backed by scientific evidence submitted for attestation in the intellectual property creation. TWO food-based cures were deemed effective at demonstrating a marked reduction in symptoms, if not a COMPLETE eradication, of the Covid-19 virus, based on initial symptom onset.  The later the application after symptom onset, the less positive the results.

The Canadian Food Inspection Agency (CFIA) already approves the specified food items for sale in Canada.

HEALTH LAW COMPLIANCE - PART TWO

Health Canada states that "A health claim is any representation in labelling or advertising that states, suggests, or implies that a relationship exists between consumption of a food or an ingredient in the food and a person's health".

Health Canada goes on to state that therapeutic claims are a type of disease risk reduction claim about disease treatment and / or are restorative in nature.

The Food & Drugs Act (FDA) prohibits the labelling and advertising of any food to the general public, as a treatment, preventative, or cure for many diseases and health conditions.  Claims about diseases and health conditions cannot be directed to the general public unless authorized in regulations.

No person shall advertise any food, drug, cosmetic or device to the general public as a treatment, preventative, or cure for any of the diseases, disorders, or abnormal physical states referred to in Schedule A.

Boomslang Analytics Inc. asserts compliance with both the Canada Health and Food & Drugs Acts and the FDA based on the following reasoning:

  • Boomslang Analytics Inc. builds information decks and disease process flow mappings (including potential remediation) based on science-driven evidence-based pre-proven factual data combined within its own proprietary framework.

  • The Ten Cures & How Bats Control Their Coronaviruses information deck was constructed based on science-driven evidence-based information; with the majority of the information collected being clinical in nature.

  • The stated health claim is truthful and not misleading.  The following scientific study confirms the above noted assertion:  https://journals.plos.org/plosone/article?id=10.1371/journal.pone.0276578

  • Boomslang Analytics Inc. does not produce nor have a relationship with ANY manufacturers or distributers of the food (manufacturers/distributors stating a food claim must be able to disclose the supporting claim evidence upon request by the CFIA) detailed in produced documents.

  • The deck itself contains 143 pages containing 1,554 individual citations. Boomslang Analytics Inc. believes that this level of documentation goes above and beyond Health Canada requirements to substantiate the above-mentioned food- based claim.

  • Lastly, Boomslang Analytics Inc. asserts that it is not a food, an ingredient within, or a derivative of, that provides the benefit but rather the net synergistic effect of the combination of different foods and their derivatives that provide the positive impact upon the human body.
